1. Acceptance of Terms

By accessing or using eCars CRM™, you agree to these Terms of Service. If you do not agree, you should not use the platform.

2. Service Provider Disclosure

IMPORTANT: eCars Inc. is a TECHNOLOGY SERVICE PROVIDER. eCars CRM™ provides automotive dealerships with customer relationship management tools, communication services, and business operations software.

No Dealer Authority: eCars Inc. does not own, operate, or control any automobile dealerships. Vehicle sales, pricing, and transaction terms are determined solely by independent dealers using our platform.
No Lending Authority: eCars Inc. does not make lending decisions, approve or deny credit applications, or set financing terms. All credit decisions are made by independent third party lenders.
Platform Only: eCars CRM™ facilitates dealer operations and customer communication. We are not a party to any vehicle sale, financing agreement, or service contract between dealers and their customers.

3. Eligibility and Accounts

You are responsible for account activity and credential security. To use account features, you must provide accurate information.

You must be at least 18 years old to create an account
You must keep login credentials confidential
You must notify us of unauthorized account access
You are responsible for all activity under your account

4. Subscription and Payments

eCars CRM™ is offered as a subscription service. By subscribing, you agree to recurring billing at the stated rate. You may cancel at any time. Cancellation takes effect at the end of the current billing period.

5. SMS Messaging Terms

eCars CRM™ enables dealers to send SMS messages to their customers. By using SMS features, you agree to the following:

Program Name: eCars CRM™ Messaging Service
Program Description: Transactional and informational messages including appointment reminders, deal updates, service follow ups, and inventory alerts
Message Frequency: Varies based on dealer usage and customer interactions
Message and Data Rates: May apply depending on mobile carrier and plan
Opt Out: Text STOP to any message to unsubscribe immediately
Help: Text HELP for assistance or contact [email protected]

Supported carriers include AT&T, T Mobile, Verizon, and all major US carriers.

6. Acceptable Use

You agree not to use eCars CRM™ for any unlawful or prohibited purpose, including:

Sending spam, unsolicited messages, or misleading communications
Submitting false or fraudulent information
Attempting to access other users' accounts or data
Using the platform to harass, threaten, or abuse others
Violating any applicable laws or regulations including CAN SPAM and TCPA
Distributing malware or attempting to compromise platform security

7. Data and Content

You retain ownership of all data you enter into eCars CRM™. By using the platform, you grant eCars Inc. a limited license to process, store, and transmit your data solely for the purpose of providing the service.

8. Intellectual Property

eCars CRM™, branding, software, and platform content are protected by intellectual property law. Patent Pending (U.S. Application #63/970,171). The eCars™ name, logo, and related marks are trademarks of eCars Inc.

9. Integrations

eCars CRM™ may integrate with third party services including eCarsList™, eCarsSocial™, email providers, SMS providers, and payment processors. These services operate under their own terms and privacy policies.

10. Disclaimer of Warranties

Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not guarantee uninterrupted operation, perfect accuracy, or guaranteed outcomes from platform usage.

11. Limitation of Liability

To the maximum extent permitted by law, eCars Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability shall not exceed the amount you paid us in the past 12 months.

12. Indemnification

You agree to indemnify and hold harmless eCars Inc. from any claims, damages, or expenses arising from your use of eCars CRM™, your violation of these Terms, or your communications with customers facilitated through our platform.

13. Account Suspension or Termination

We may suspend or terminate accounts for fraud, abuse, legal non compliance, or violation of these Terms. Upon termination, your right to use the services will immediately cease.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

15. Changes to Terms

We may update these Terms from time to time. Continued platform use after updates means you accept the revised Terms.
